There is GPL-ed XCDROM (for IDE and from author of QCDROM) and GCDROM(for SATA) - they can be a material for this development.

Burning software in DOS requires ASPI layer for CDROM driver - I know only one - ASPI for ATAPI from OAK Technologies (only IDE and no UDMA)

P.S. Perhaps, it will be possible to turn QCDROM in GPL software too - encryption of driver, pointers inside it, and antiFreeDOS module are eliminated now. README.TXT of driver doesn't contain license, so I suppose it was GPL without sources ;-). But its disassembling is a rather complicated thing.
