What about releasing EDR-DOS (or whatever) DEFRAG with a better version check? This is the reason the GPL is good: You are always allowed to improve the program, or fork of your own version.

Besides, I don't think DEFRAG's version check was written with bad intention. DOS programmers tend to believe ("really true") MS-DOS version numbers are a good version check.
